Bu a\u00e7\u0131dan \u00f6ncelikle uluslararas\u0131 insanc\u0131l hukukun ne oldu\u011funun do\u011fru anla\u015f\u0131lmas\u0131 \u00f6nem arz ediyor.<\/p>\n<p>Uluslararas\u0131 insanc\u0131l hukuk, silahl\u0131 \u00e7at\u0131\u015fan taraflar\u0131, sivilleri ve do\u011fal varl\u0131klar\u0131 korumay\u0131 ama\u00e7layan uluslararas\u0131 antla\u015fma ve \u00f6rf-adet kurallar\u0131n\u0131 i\u00e7eriyor. Bu kurallar, \u00e7at\u0131\u015fman\u0131n taraflar\u0131n\u0131n kullanabilece\u011fi silahlar\u0131 ve \u00e7at\u0131\u015fma y\u00f6ntemlerini s\u0131n\u0131rl\u0131yor.<\/p>\n<p>Sava\u015f hukuku olarak da bilinen insanc\u0131l hukuk kurallar\u0131n\u0131n ciddi \u015fekilde ihlali durumunda ise sava\u015f su\u00e7u olu\u015fuyor. \u00d6rne\u011fin, \u0130srail\u2019in \u00e7at\u0131\u015fmalarda kullan\u0131lmas\u0131 yasak olan beyaz fosforu Gazze&#8217;nin kuzeyinde Kerame b\u00f6lgesinde Filistinlilere kar\u015f\u0131 kullanmas\u0131, uluslararas\u0131 insanc\u0131l hukukun a\u011f\u0131r bir ihlali olmas\u0131 dolay\u0131s\u0131yla sava\u015f su\u00e7u olu\u015fturuyor. Bu durumda beyaz fosforu kullanan, kullan\u0131lmas\u0131n\u0131 emreden ve kullanmas\u0131n\u0131 engelleme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunan \u0130srailli askerlerin, komutanlar\u0131n ve devlet g\u00f6revlilerinin &#8220;sava\u015f su\u00e7u&#8221; i\u015fledi\u011fi g\u00f6r\u00fcl\u00fcyor.<\/p>\n<h3>Uluslararas\u0131 insanc\u0131l hukuk ve sava\u015f hukuku ayr\u0131m\u0131 nedir?<\/h3>\n<p>\u201cSava\u015f\u201d tabiri iki devletin ordular\u0131 aras\u0131ndaki \u00e7at\u0131\u015fmalar i\u00e7in kullan\u0131l\u0131rken, silahl\u0131 \u00f6rg\u00fctlerin de \u00e7at\u0131\u015fmalar\u0131n taraf\u0131 haline gelmesiyle birlikte \u201csava\u015f\u201d terimi yerine \u201csilahl\u0131 \u00e7at\u0131\u015fma\u201d ibaresi kullan\u0131lmaya ba\u015fland\u0131.<\/p>\n<p>Taraflar\u0131ndan birinin sadece devlet olmayan silahl\u0131 \u00f6rg\u00fctlerin te\u015fkil etti\u011fi \u00e7at\u0131\u015fmalara \u201culuslararas\u0131 olmayan silahl\u0131 \u00e7at\u0131\u015fma\u201d deniyor, e\u011fer her iki tarafta da bir devlet \u00e7at\u0131\u015fmaya k\u0131smen de olsa kat\u0131l\u0131rsa \u201culuslararas\u0131 silahl\u0131 \u00e7at\u0131\u015fma\u201d ibaresi kullan\u0131l\u0131yor.<\/p>\n<p>Bu iki hukuk dal\u0131 b\u00fcy\u00fck oranda ayn\u0131 \u015feyi ifade ediyor. Daha \u00f6nceden sadece devletler aras\u0131ndaki sava\u015fa ili\u015fkin olmas\u0131 ve merkezine sadece askeri ama\u00e7lar\u0131 almas\u0131 sebebiyle \u201csava\u015f hukuku\u201d olarak da adland\u0131r\u0131lan bu hukuk dal\u0131, art\u0131k merkezine insan\u0131n korunmas\u0131n\u0131 ve sava\u015f d\u0131\u015f\u0131ndaki silahl\u0131 \u00e7at\u0131\u015fmalar\u0131 da ele almas\u0131yla birlikte \u201cinsanc\u0131l hukuk\u201d ifadesiyle tan\u0131mlan\u0131yor.<\/p>\n<h3>Uluslararas\u0131 insanc\u0131l hukukun kaynaklar\u0131 neler?<\/h3>\n<p>Uluslararas\u0131 insanc\u0131l hukukun kaynaklar\u0131 y\u00fczy\u0131llar boyunca insanl\u0131\u011f\u0131n ortakla\u015fa \u00fcretti\u011fi ve yaz\u0131l\u0131 olmayan \u201csilahl\u0131 \u00e7at\u0131\u015fmalara ili\u015fkin team\u00fcl kurallar\u0131\u201d ve yaz\u0131l\u0131 anla\u015fmalardan olu\u015fuyor.<\/p>\n<p>Team\u00fcl kurallar\u0131 \u0130slam hukukunda da yer alan esirlerin \u00f6ld\u00fcr\u00fclmemesi, teslim olanlara eziyet \u00e7ektirilmemesi ve d\u00fc\u015fman\u0131n a\u015fa\u011f\u0131lanmamas\u0131 gibi \u00e7ok \u00e7e\u015fitli kurallar\u0131 i\u00e7eriyor.<\/p>\n<p>Uluslararas\u0131 insanc\u0131l hukukun yaz\u0131l\u0131 kurallar\u0131 ise temelde Lahey s\u00f6zle\u015fmeleri ve Cenevre Konvansiyonlar\u0131 olarak iki grupta topland\u0131. \u0130lk olarak 1864 tarihli Cenevre S\u00f6zle\u015fmesi ile ba\u015flayan bu s\u00f6zle\u015fmeler, temelde insana eziyet veren ve kullan\u0131lmamas\u0131 gereken sava\u015f y\u00f6ntemlerini ve ara\u00e7lar\u0131n\u0131 belirliyor.<\/p>\n<p>Silah teknolojilerindeki geli\u015fmeler ve \u00f6zellikle \u0130kinci D\u00fcnya Sava\u015f\u0131&#8217;nda g\u00f6r\u00fclen insani yard\u0131m ihtiyac\u0131n\u0131 kar\u015f\u0131lamak i\u00e7in ortaya \u00e7\u0131kan 1949 Cenevre S\u00f6zle\u015fmeleri, 1925 Cenevre Protokol\u00fc, 1977\u2019deki ek protokoller, 1993 Kimyasal Silahlar S\u00f6zle\u015fmesi, 1997 Antipersonel May\u0131nlar S\u00f6zle\u015fmeleri ve 1998 tarihli Roma Stat\u00fcs\u00fc insanc\u0131l hukukun ba\u015fl\u0131ca kaynaklar\u0131n\u0131 olu\u015fturuyor.<\/p>\n<p>\u0130srail insanc\u0131l hukuk s\u00f6zle\u015fmelerinden baz\u0131lar\u0131na taraf olmasa da s\u00f6z konusu kurallar\u0131n b\u00fcy\u00fck k\u0131sm\u0131n\u0131n team\u00fcl hukuku olmas\u0131 sebebiyle, Gazze\u2019ye y\u00f6nelik operasyonlar\u0131nda insanc\u0131l hukuk \u0130srail&#8217;i de ba\u011flayan bir hukuk rejimi olarak kabul ediliyor.<\/p>\n<p>\u00d6te yandan \u0130srail\u2019in s\u00f6z konusu sald\u0131r\u0131lar\u0131 \u201cHamas\u2019\u0131n ter\u00f6r sald\u0131r\u0131lar\u0131\u201d olarak nitelendirerek, insanc\u0131l hukukun ekseninden \u00e7\u0131karmay\u0131 ama\u00e7lamas\u0131 da ge\u00e7erli bir hukuki neden olarak g\u00f6r\u00fclm\u00fcyor zira s\u00f6z konusu kar\u015f\u0131l\u0131kl\u0131 sald\u0131r\u0131lar\u0131n \u201csilahl\u0131 \u00e7at\u0131\u015fma\u201d boyutuna varm\u0131\u015f olmas\u0131 sebebiyle \u0130srail her durumda, hakl\u0131 ya da haks\u0131z taraf olmas\u0131na bak\u0131lmaks\u0131z\u0131n insanc\u0131l hukuk kurallar\u0131yla ba\u011fl\u0131 bulunuyor.<\/p>\n<h3>Uluslararas\u0131 insanc\u0131l hukukun temel kurallar\u0131 neler?<\/h3>\n<p>Uluslararas\u0131 insanc\u0131l hukuk, \u00e7at\u0131\u015fmalarda temel kurallar\u0131 belirliyor. Bu antla\u015fmalar, sivil halk\u0131n, yaral\u0131lar\u0131n, hastalar\u0131n ve sava\u015f esirlerinin korunmas\u0131, silah kullan\u0131m\u0131n\u0131n s\u0131n\u0131rlanmas\u0131 ve insani yard\u0131m\u0131n sa\u011flanmas\u0131 konular\u0131nda uluslararas\u0131 standartlar\u0131 belirliyor. Buna ek olarak, sivil halk ve sava\u015f\u00e7\u0131lar aras\u0131nda ay\u0131r\u0131m yapmay\u0131, sivillere toplu veya bireysel sald\u0131r\u0131lar\u0131 yasakl\u0131yor. Teslim olan veya \u00e7at\u0131\u015fmalar\u0131n d\u0131\u015f\u0131nda kalan ki\u015filere sayg\u0131 g\u00f6stermeyi, yaral\u0131lar\u0131n ve hastalar\u0131n \u00f6zel korunmas\u0131n\u0131 sa\u011fl\u0131yor.<\/p>\n<p>\u00d6yle ki \u00e7at\u0131\u015fmalarda yaralanan ve art\u0131k sava\u015famayacak durumda olan bir ki\u015fi de tedavi g\u00f6rd\u00fc\u011f\u00fc esnada \u201csava\u015fan\u201d stat\u00fcs\u00fcnde de\u011fil \u201csivil\u201d stat\u00fcs\u00fcnde yer al\u0131yor. \u0130nsanc\u0131l hukuk, sa\u011fl\u0131k personeli ve tesislerinin korunmas\u0131, K\u0131z\u0131lha\u00e7 veya K\u0131z\u0131lay amblemine sayg\u0131 g\u00f6sterilmesini de gerektiriyor.<\/p>\n<p>Tutsak askerlerin ve sivillerin ya\u015fam, onur, ki\u015fisel haklar ve aileleriyle ileti\u015fim haklar\u0131na sayg\u0131 g\u00f6sterilmesi de bu hukukun ayr\u0131lmaz bir par\u00e7as\u0131. Buradan yap\u0131lan bir \u00e7\u0131kar\u0131mla, uluslararas\u0131 insanc\u0131l hukukun, rehine alma ve sivilleri tutsak etmeye ili\u015fkin kategorik bir yasak getirmedi\u011fi kabul ediliyor.<\/p>\n<p>\u0130srail, Birle\u015fmi\u015f Milletler nazar\u0131nda i\u015fgali alt\u0131nda bulunan Gazze \u015eeridi&#8217;ndekileri, Cenevre S\u00f6zle\u015fmeleri kapsam\u0131nda \u00e7at\u0131\u015fma hukuku \u00e7er\u00e7evesinde birtak\u0131m kurallara uymak \u015fart\u0131yla tahliye edebiliyor ancak bu, Gazze&#8217;dekilerin kitlesel olarak ve gelece\u011fi belirsiz \u015fekilde yerlerinden \u00e7\u0131kart\u0131labilece\u011fi anlam\u0131na gelmiyor.<\/p>\n<p>\u00dcstelik b\u00f6yle bir durumda dahi, yerinden edilecek ki\u015filerin sa\u011fl\u0131kl\u0131, g\u00fcvenli ve makul bir \u015fekilde yeni yerlerine ge\u00e7mesinin beklenmesi, geri d\u00f6n\u00fc\u015f haklar\u0131 ile buna ili\u015fkin tedbirlerin al\u0131nmas\u0131 gerekiyor. Bu a\u00e7\u0131dan \u0130srail\u2019in Gazze\u2019nin g\u00fcneyine ge\u00e7meye \u00e7al\u0131\u015fan sivillere y\u00f6nelik sald\u0131r\u0131lar\u0131n\u0131n da a\u00e7\u0131k bir sava\u015f su\u00e7u oldu\u011fu g\u00f6r\u00fcl\u00fcyor. Ayr\u0131ca \u0130srail, zorla g\u00f6\u00e7 ettirdi\u011fi sivillerin geri d\u00f6n\u00fc\u015fleri konusunda da bir plan sunmuyor.<\/p>\n<p>Buna ek olarak, \u0130srailli yetkililerin Gazze&#8217;deki halk\u0131n \u00fclke d\u0131\u015f\u0131na, \u00f6zellikle M\u0131s\u0131r\u2019a s\u00fcr\u00fclmesi kabilinden niyetleri insanc\u0131l hukuk anlam\u0131nda bir tahliye olmay\u0131p insanc\u0131l hukukun temel amac\u0131na ayk\u0131r\u0131 bir durum olarak kendini g\u00f6steriyor.<\/p>\n<h3>\u0130nsanc\u0131l hukuk kimleri ba\u011fl\u0131yor?<\/h3>\n<p>Uluslararas\u0131 insanc\u0131l hukuk, silahl\u0131 \u00e7at\u0131\u015fman\u0131n t\u00fcm taraflar\u0131n\u0131 ba\u011fl\u0131yor. S\u00f6z konusu kurallar\u0131n bir \u00e7o\u011fu team\u00fcl niteli\u011finde oldu\u011fundan, bir devletin ya da silahl\u0131 \u00f6rg\u00fct\u00fcn, herhangi bir uluslararas\u0131 anla\u015fmaya taraf olmas\u0131na bak\u0131lmaks\u0131z\u0131n, insanc\u0131l hukukun kurallar\u0131na uymas\u0131 zorunlu.<\/p>\n<p>Ayr\u0131ca, 2010 itibar\u0131yla d\u00fcnya genelinde 194 devlet Cenevre S\u00f6zle\u015fmeleri&#8217;ne taraf olurken, 170 devlet s\u00f6zle\u015fmelerin I. protokol\u00fcne ve 165 devlet II. protokol\u00fcne kat\u0131ld\u0131. Bu geni\u015f kat\u0131l\u0131m, s\u00f6zle\u015fmelerin evrenselli\u011fini g\u00f6steriyor. Eski Yugoslavya mahkemesinin i\u00e7tihad\u0131na g\u00f6re, bu kurallar\u0131n \u00f6nemli bir k\u0131sm\u0131, uluslararas\u0131 olmayan nitelikteki silahl\u0131 \u00e7at\u0131\u015fmalar\u0131 da kaps\u0131yor. \u0130srail-Filistin olay\u0131nda, \u0130srail ordusu, Hamas, Bat\u0131 \u015eeria\u2019daki Filistin y\u00f6netimi ba\u015fta olmak \u00fczere \u00e7at\u0131\u015fmaya kat\u0131lan ve destek veren t\u00fcm taraflar, insanc\u0131l hukuk kurallar\u0131yla ba\u011fl\u0131.<\/p>\n<p>\u00d6te yandan, Akdeniz\u2019e sava\u015f gemisi g\u00f6nderen ABD, sava\u015f gemisi g\u00f6nderece\u011fini a\u00e7\u0131klayan \u0130ngiltere, Fransa gibi devletler ile Gazze\u2019ye kara operasyonu yap\u0131lmas\u0131 durumunda \u00e7at\u0131\u015fmaya kat\u0131laca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclen Hizbullah ve Husiler gibi silahl\u0131 gruplar da yine insanc\u0131l hukukla ba\u011fl\u0131 oluyor.<\/p>\n<h3>Uluslararas\u0131 insanc\u0131l hukuk, hangi durumlarda uygulan\u0131yor?<\/h3>\n<p>Uluslararas\u0131 insanc\u0131l hukuk, iki durumda uygulan\u0131yor ve iki farkl\u0131 koruma sistemi sunuyor:<\/p>\n<p>\u0130lk olarak; uluslararas\u0131 silahl\u0131 \u00e7at\u0131\u015fmalarda Cenevre S\u00f6zle\u015fmeleri ve I. ek protokol ge\u00e7erli olurken, bu kapsamda, kara ve deniz sava\u015flar\u0131nda yaral\u0131 veya hasta askerler, sa\u011fl\u0131k hizmetleri mensuplar\u0131, sava\u015f esirleri, sivil halk (\u00f6rne\u011fin, sava\u015f taraflar\u0131n\u0131n topraklar\u0131nda bulunan yabanc\u0131 siviller, i\u015fgal alt\u0131ndaki b\u00f6lgelerdeki siviller, sivil tutuklular ve sa\u011fl\u0131k personeli) korunur.<\/p>\n<p>Filistin \u00f6rne\u011finde oldu\u011fu \u00fczere, ulusal ba\u011f\u0131ms\u0131zl\u0131k sava\u015flar\u0131 da uluslararas\u0131 silahl\u0131 \u00e7at\u0131\u015fma kategorisine dahil ediliyor. Bu sebeple \u0130srail-Hamas aras\u0131ndaki \u00e7at\u0131\u015fmalar, Gazze\u2019nin i\u015fgal alt\u0131nda olmas\u0131 ve ba\u011f\u0131ms\u0131zl\u0131k sava\u015f\u0131 y\u00fcr\u00fctmesi bak\u0131m\u0131ndan uluslararas\u0131 nitelikteki bir silahl\u0131 \u00e7at\u0131\u015fma olup, \u0130srail ve Hamas&#8217;\u0131n fiileri a\u00e7\u0131s\u0131ndan insanc\u0131l hukuk t\u00fcm kurallar\u0131yla uygulama alan\u0131 buluyor.<\/p>\n<p>\u0130kinci olarak uluslararas\u0131 nitelikte olmayan silahl\u0131 \u00e7at\u0131\u015fmalarda ise d\u00f6rt Cenevre S\u00f6zle\u015fmesi&#8217;nin ortak 3. maddesi, I. ek protokol ve baz\u0131 durumlarda II. ek protokol uygulan\u0131yor. Bu durumda, yaral\u0131 veya hasta muharip askerler, \u00e7at\u0131\u015fma nedeniyle \u00f6zg\u00fcrl\u00fcklerinden mahrum edilmi\u015f ki\u015filer, sivil halk, sa\u011fl\u0131k personeli ve din adamlar\u0131 koruma alt\u0131nda bulunuyor.<\/p>\n<h3>Abluka nedir ve nas\u0131l uygulan\u0131yor?<\/h3>\n<p>Uluslararas\u0131 insanc\u0131l hukuk kapsam\u0131nda abluka, \u00e7at\u0131\u015fan taraflardan birinin, di\u011fer taraf\u0131n \u00fc\u00e7\u00fcnc\u00fc devletlerle ili\u015fkilerini engellemek amac\u0131yla uygulanan bir y\u00f6ntem olarak kar\u015f\u0131m\u0131za \u00e7\u0131k\u0131yor. Sava\u015fan taraflardan biri, di\u011ferinin limanlar\u0131n\u0131 ku\u015fatarak, t\u00fcm gemi ve u\u00e7aklar\u0131n abluka hatt\u0131n\u0131 ge\u00e7i\u015flerini denetim alt\u0131na alarak ger\u00e7ekle\u015ftiriyor.<\/p>\n<p>Bu y\u00f6ntem, abluka alt\u0131ndaki taraf\u0131n a\u00e7\u0131k denizlere \u00e7\u0131k\u0131\u015f\u0131n\u0131 ve ticari ili\u015fkilerini s\u00fcrd\u00fcrme yetene\u011fini azaltmay\u0131 hedefliyor. Abluka, sava\u015fan gruplar\u0131n d\u0131\u015f\u0131nda sivil halk\u0131n temel ya\u015fam\u0131n\u0131 ciddi derecede etkilemesi ve sivil halk\u0131 cezaland\u0131r\u0131c\u0131 boyuta ula\u015fmas\u0131 durumunda insanc\u0131l hukukun ihlalini olu\u015fturuyor. Dolay\u0131s\u0131yla insanc\u0131l hukuk, Gazze&#8217;ye uygulanan tam abluka gibi toplu cezaland\u0131rmay\u0131 da yasakl\u0131yor. Burada i\u015fgalci g\u00fc\u00e7 say\u0131lan \u0130srail\u2019in, su ve elektri\u011fi kesmesi, sava\u015f hukukunun a\u00e7\u0131k bir ihlali olup, sava\u015f su\u00e7u te\u015fkil ediyor.<\/p>\n<p>S\u00f6z konusu elektrik ve su altyap\u0131lar\u0131n\u0131n Hamas taraf\u0131ndan da kullan\u0131l\u0131yor olmas\u0131, Gazze\u2019deki 2 milyondan fazla halk\u0131n cezaland\u0131r\u0131lmas\u0131na me\u015fruiyet sa\u011flam\u0131yor. Gazze\u2019deki mevcut durumda, \u0130srail\u2019in g\u0131da ve ila\u00e7 dahil insani yard\u0131mlar\u0131n sa\u011flanmas\u0131n\u0131 engellemesi sava\u015f hukukunun a\u00e7\u0131k bir ihlali olup, sava\u015f su\u00e7u te\u015fkil ediyor.<\/p>\n<h3>\u0130nsanc\u0131l hukuka riayet edilmemesi durumunda ne oluyor?<\/h3>\n<p>Uluslararas\u0131 insanc\u0131l hukukun uygulanmas\u0131 i\u00e7in \u00e7at\u0131\u015fan taraflar\u0131n denetlenmesi gerekiyor. \u0130nsanc\u0131l hukukun ihlali durumunda sava\u015f su\u00e7lar\u0131 s\u00f6z konusu oluyor ve bu su\u00e7lara ili\u015fkin yarg\u0131lanmalar hem yerel mahkemeler hem de uluslararas\u0131 mahkemeler taraf\u0131ndan yap\u0131labiliyor.<\/p>\n<h3>Her sivil kayb\u0131 sava\u015f su\u00e7u anlam\u0131na geliyor mu?<\/h3>\n<p>Silahl\u0131 \u00e7at\u0131\u015fmalarda sivil kayb\u0131n\u0131n ya\u015fanmas\u0131 her durumda sava\u015f su\u00e7u anlam\u0131na gelmemekle birlikte, sivillerin do\u011frudan hedef al\u0131nd\u0131\u011f\u0131 durumlarda sava\u015f su\u00e7u te\u015fkil edebiliyor.<\/p>\n<p>\u00d6zellikle askeri ama\u00e7la kullan\u0131ld\u0131\u011f\u0131 iddia edilen bir sivil hedefin, s\u00f6z konusu askeri ama\u00e7la kullan\u0131ld\u0131\u011f\u0131na ili\u015fkin ger\u00e7ek\u00e7i deliller olmamas\u0131 durumunda sava\u015f su\u00e7u meydana gelebiliyor.<\/p>\n<p>\u00d6te yandan, askeri bir hedefe yap\u0131lan sald\u0131r\u0131 sebebiyle meydana gelebilecek sivil kay\u0131plar\u0131n\u0131n da hesaplanmas\u0131 ve e\u011fer s\u00f6z konusu sald\u0131r\u0131 sebebiyle meydana gelebilecek muhtemel sivil kayb\u0131 sald\u0131r\u0131yla elde edilecek askeri avantaj\u0131 a\u015f\u0131yorsa bu sald\u0131r\u0131n\u0131n d\u00fczenlenmemesi gerekiyor.<\/p>\n<p>\u00d6rne\u011fin, \u0130srail&#8217;in Gazze&#8217;deki el-Ehli Baptist Hastanesine d\u00fczenledi\u011fi, y\u00fczlerce ki\u015finin \u00f6l\u00fcm\u00fcne yol a\u00e7an sald\u0131r\u0131da, s\u00f6z konusu hastanenin Hamas taraf\u0131ndan kullan\u0131ld\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclse dahi; sald\u0131r\u0131n\u0131n \u0130srail\u2019e askeri a\u00e7\u0131dan fayda sa\u011flamas\u0131 yeterli olmay\u0131p, binan\u0131n hastane olmas\u0131, buradakilerin yaral\u0131 ve tedavi g\u00f6ren insanlar olmas\u0131 ve tamam\u0131na yak\u0131n\u0131n\u0131n sivillerden olu\u015fmas\u0131 sebebiyle s\u00f6z konusu sald\u0131r\u0131 insanc\u0131l hukukun ihlali anlam\u0131na geliyor.
